1. Acceptance

These Terms of Service (“Terms”) are an agreement between you and Oleksandr Ksondzyk, the developer and operator of Tracket Motion: Video Editor (“Tracket”, “the app”, “we”, “us”, or “our”). By downloading, accessing, or using Tracket, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the service. You must be legally capable of entering into these Terms. If you use Tracket on behalf of another person or organization, you represent that you are authorized to accept these Terms for them.

2. The service

Tracket provides mobile video-editing features that may include object and camera tracking, stabilization, overlays, keyframe animation, audio tools, preview, export, and related functionality. Features may vary by platform, device capability, app version, region, subscription status, remote configuration, and third-party service availability.

The free version may include a watermark, advertising, feature limits, or rewarded-ad options. Pro features may be offered through subscriptions, lifetime purchases, trials, or promotions where available.

3. Limited license

Subject to these Terms and the applicable app-store rules, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Tracket for lawful personal or business video-editing purposes.

You may not copy, sell, rent, redistribute, reverse engineer, bypass technical restrictions, or create derivative services from Tracket except where applicable law expressly permits it.

4. Your media and exports

You retain ownership of videos, photos, audio, projects, and other content you import or create. You are responsible for ensuring that you have all rights, permissions, releases, and licenses needed to edit, export, publish, or distribute that content.

Tracket normally processes project media on your device. You are responsible for maintaining backups. Deleting the app, clearing app data, changing devices, storage failure, or operating-system actions may permanently remove local projects.

You grant us only the limited rights needed to process support information or optional diagnostics that you explicitly submit, as described in the Privacy Policy.

5. Purchases, subscriptions, and refunds

  • Purchases are processed by Google Play or Apple, not directly by Tracket.
  • Prices, billing periods, trial terms, renewal details, and included features are shown in the app and store purchase interface before confirmation.
  • Subscriptions renew automatically unless canceled through the relevant store before the renewal date, subject to that store’s rules.
  • You can manage or cancel subscriptions through your Google Play or Apple account settings.
  • Refund requests are handled under the policies and decisions of the store that processed the purchase.
  • Restore Purchase may require the same store account that made the original purchase and an active network connection.

We may change future prices or offerings. Store rules determine whether and how a change applies to an existing subscription. Mandatory consumer rights are not limited by these Terms.

6. Advertising and rewarded access

Eligible free users may be offered rewarded ads, including an option to export without a watermark after completing an ad. Ad availability, content, duration, eligibility, and successful reward delivery depend on Google Mobile Ads, consent, connectivity, region, inventory, and device state. An ad opportunity is not guaranteed.

Advertising privacy choices are managed through the consent and platform controls described in our Privacy Policy. Pro users may receive an ad-free experience according to the offer shown at purchase.

7. Acceptable use

You must not:

  • use Tracket to violate law, intellectual-property rights, privacy, publicity rights, or contractual obligations;
  • upload malicious, deceptive, unlawful, or abusive material through support;
  • attempt to defeat purchase verification, licensing, integrity checks, rate limits, advertising rewards, watermarks, or security controls;
  • interfere with the app, backend, stores, providers, or another user’s access;
  • probe, scrape, overload, or access non-public service interfaces without authorization;
  • misrepresent your identity, entitlement, or authority when contacting support.

8. Third-party services

Tracket depends on services provided by Google, Apple, Firebase, Google Mobile Ads, Cloudflare, device manufacturers, operating systems, and app stores. Third-party services are governed by their own terms and policies. We are not responsible for third-party outages, decisions, content, billing systems, account restrictions, or policy changes.

9. Availability, updates, and support

We may add, change, limit, suspend, or discontinue features to improve the service, address security or legal requirements, respond to provider changes, or maintain compatibility. Updates may be required for continued use.

We aim to provide a reliable service but do not guarantee uninterrupted access, compatibility with every format or device, permanent availability of any feature, or that every tracking or export result will meet a particular creative or technical expectation.

10. Disclaimers

To the maximum extent permitted by law, Tracket is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free results. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Keep independent copies of important source media and exports. Tracket is not a backup or archival service.

11. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, profits, goodwill, or business opportunity; or losses caused by third-party services, device failure, unsupported media, or your failure to keep backups.

Where liability cannot be excluded, it is limited to the greater of the amount you paid for Tracket during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law. This limitation does not apply where prohibited, including liability that cannot legally be limited.

12. Suspension and termination

You may stop using Tracket at any time. We may suspend access to backend or support functionality when reasonably necessary to protect the service, comply with law, investigate abuse, or enforce these Terms. Store purchases and subscription cancellation remain subject to the relevant store’s rules.

13. Changes and general terms

We may update these Terms. The current version and effective date will be published at this URL. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.

If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms are governed by applicable law, without limiting mandatory consumer protections available in your country or region.
